1. Definitions
1.1 MIO Personal Training (Chamber of Commerce 63902206), located in Nijmegen, Weurtseweg 452 6541BE.
1.2 Member: Anyone who purchases a service from MIO Personal Training (hereinafter: MIO).
1.3 Membership: The service contracted by the member with MIO.
1.4 Personal Data: All data provided by the member to MIO.
2. Applicability
2.1 These general terms and conditions apply to all legal relationships between MIO and every member.
2.2 All provisions in these general terms and conditions are also drawn up for the benefit of all directors of MIO and all persons working for MIO and/or engaged by MIO.
2.3 Deviations from these general terms and conditions are only valid if expressly agreed upon in writing.
3. Risk and Liability
3.1 The use of MIO’s facilities for, among other things, but not limited to, strength and conditioning training and/or following any training program and/or activities of any kind at MIO is entirely at the member’s own risk.
3.2 The member is obliged to report his or her physical condition, such as injuries, illnesses, and/or other physical conditions, both before, during, and after any training supervised by a trainer, and to provide information that the member reasonably should understand is necessary for performing exercises. The member is responsible for reporting this information.
3.3 Neither MIO nor its employees are liable for material and/or immaterial damage as a result of an accident or injury/injuries to the member and/or third parties.
3.4 MIO and its employees accept no liability for damage, loss, or theft of property belonging to the member and/or third parties.
3.5 The member is liable for damage caused to MIO’s property if such damage is the result of negligence and/or fault of the member.
3.6 The exclusions and limitations of liability as stated in this article also apply to and are made for the benefit of subordinates of MIO and any other person whose assistance MIO uses in performing the membership.
4. Personal Data and Privacy Policy
4.1 The member is aware that he/she provides certain personal data to MIO, such as, but not limited to, name, age, address, and email address.
4.2 If the member agrees to these terms, the member gives MIO permission to process his/her personal data in connection with its commercial use by MIO. Any processing of personal data by MIO complies with the Dutch Personal Data Protection Act (WBP). MIO will destroy all data of the member upon written request of the member.
4.3 By agreeing to these general terms and conditions, the member unequivocally gives MIO permission to send offers to the member by email and other means.
5. Payments and Cancellations
5.1 The member must make the payment in advance.
5.2 The member is not entitled to a refund.
5.3 All services are valid for a maximum of 6 months. After 6 months, the credits expire. This also applies to gift vouchers.
5.4 The member must cancel 48 hours in advance, otherwise, the service will be charged.
5.5 Training sessions typically last 1 hour.
6. Applicable Law and Competent Court
6.1 These general terms and conditions come into effect on July 1, 2015.
6.2 In the event that any provision in these membership terms and conditions is declared void or is nullified, this does not affect the validity of the other provisions. MIO and the member will then enter into consultations to agree on new provisions to replace the void or nullified provisions, while as much as possible, the purpose and scope of the original provision are observed.
6.3 Any legal relationship with MIO is governed by Dutch law. All disputes between the member and MIO arising out of or in connection with the membership will be settled exclusively by the competent court.
